Account Terms and Conditions

1. You must provide your own personal details when registering.
2. Your login details are strictly personal and may not be divulged to any other person.
3. You are personally responsible for keeping your user name and/or password secret at all times.
4. You are responsible for all activities and content held under your account (including for the users created under your account).
5. You are not permitted to use the Suspension Portal system of VB-Airsuspension B.V. for illegal purposes; you must not act in any way that is contrary to European legislation.
6. VB-Airsuspension B.V. reserves the right to disable an account (temporarily or otherwise) and to deny access to the Suspension Portal should the user, in using their account and the Suspension Portal, act contrary to these Terms and Conditions, the interests of VB-Airsuspension, the law and/or common decency.
7. VB-Airsuspension B.V. reserves the right to refuse to register an account without giving reasons, in which case this will be communicated as early as possible.
8. It is not permitted to spread, send or upload computer viruses or otherwise harmful files or programs that could damage, render inoperable or inaccessible, erase or appropriate any computerised files or data, or that are intended to circumvent technical security features of the website and/or the computer systems of VB-Airsuspension B.V.
9. You are required to change your password every six months.
10. Your password must be made up of at least eight characters and include at least one number and one punctuation mark.
11. As a user of the Suspension Portal, you are responsible for ensuring that you use the correct files or information at all times. No rights may be derived from the incorrect use of files or information, such as the use of older or outdated versions.

 

Confidentiality

12. The Suspension Portal user undertakes to put measures in place with a view to ensuring confidentiality towards third parties in respect of all confidential information such as, but not limited to, details and knowledge about VB-Airsuspension B.V.'s business affairs that came into the possession of the Suspension Portal user and their employee(s) and other third parties engaged by them in the course of working for VB-Airsuspension B.V., or in the course of concluding an agreement with VB-Airsuspension B.V.

1. The Suspension Portal user undertakes that they and their employees and other third parties engaged by them will not in any way, directly or indirectly, verbally, in writing or otherwise, disclose to third parties any information relating to or arising from their actual relationship with VB-Airsuspension B.V. other than with the prior written consent of VB-Airsuspension B.V.
2. The Suspension Portal user shall refrain from exploiting specific product knowledge in respect of VB-Airsuspension B.V. obtained in the context of the performance of their work. This specific product knowledge shall be kept confidential by the Suspension Portal user even after the relationship with VB-Airsuspension B.V. comes to an end and shall not be used in any way other than that prescribed by VB-Airsuspension B.V.
3. The provisions of the previous paragraphs of this declaration do not apply to facts, information, knowledge, documents and other matters if the user can demonstrate that the said information:
   a. had already been published or had otherwise become generally known at the time it came to their knowledge;
   b. was published or had otherwise become generally known after it came to their knowledge, other than by any act or omission by the Suspension Portal user;
   c. was developed by the Suspension Portal user independently of any relationship with VB-Airsuspension B.V.;
   d. was made public with the express consent of VB-Airsuspension B.V.;
   e. should have been disclosed on legal grounds or on the order of a legal body.
4. All designs recorded in graphical and alphanumeric form, drawings, models, notes and the like stored on media of whatever kind, as well as copies thereof, which were obtained or made by the Suspension Portal user during the course of the relationship with VB-Airsuspension B.V., shall remain the property of VB-Airsuspension B.V.
5. After termination of the relationship with VB-Airsuspension B.V. or an agreement between VB-Airsuspension B.V. and the Suspension Portal user, the Suspension Portal user shall immediately return to VB-Airsuspension B.V. the information and documents that they have received or produced during the course of the work or the term of the agreement, without retaining any copies.
6. If the Suspension Portal user produces an invention that can be considered as resulting from the relationship with VB-Airsuspension B.V., VB-Airsuspension B.V. shall retain the title to such invention. The Suspension Portal user shall be obliged to immediately inform VB-Airsuspension B.V. of such an invention and to provide VB-Airsuspension B.V. with every assistance as required by VB-Airsuspension B.V. for the application and/or patenting of this invention.
7. The Suspension Portal user must impose the obligations arising from this declaration on their employees and other third parties engaged by them.

 

Content

20. VB-Airsuspension has put together all the pages on the Suspension Portal with great care and attention to detail. However, the possibility that they may contain mistakes or incomplete information cannot be excluded. VB-Airsuspension does not accept liability for any direct loss resulting from factual inaccuracies in the information provided or otherwise arising from the use of or inability to use the information provided.

 

This expressly includes inaccuracies in information originating from third parties (suppliers) that is published on the Suspension Portal. VB-Airsuspension accepts no liability whatsoever for direct or indirect losses resulting from technical faults, whereby pages are unavailable or not fully available at any time or during a certain period.

All specified percentages, costs and prices are subject to change; no rights may be derived from this information.

 

We have taken the greatest possible care to obtain images and video clips with the appropriate rights. If you believe that images or video clips are being used for which the appropriate rights have not been obtained, please notify us by e-mail to marketing@vbairsuspension.com. We will then come to a suitable agreement or will immediately delete the image(s) and/or video clip(s) for which there is proof that appropriate rights have not been obtained.

 

Personal Data and the Purpose of Data Processing

 

21. VB-Airsuspension collects personal data for the following purpose: to create a user account on the Suspension Portal. You can register for the Suspension Portal via the portal.vbairsuspension.com website or via the link on our website: vbairsuspension.com.

VB-Airsuspension collects the following information for this purpose: company name, title, first name, surname, language, e-mail address. 
You are not obliged to provide your personal data, however please note that certain services, such as an account for the Suspension Portal, may not be available to you unless you agree to the processing of your data.

Personal data is stored by VB-Airsuspension and processed for the period that is necessary in relation to the purposes for which the data is processed.

The Dutch Personal Data Protection Act states that individuals have the right of access to personal data held about them. In addition, it must be possible to correct, supplement, remove and/or block this information.

Where data is factually incorrect, this is a legitimate reason for the data to be amended. Also, where information is inadequate or incomplete for the purpose, is not strictly necessary for the purpose or is in violation of statutory regulations, VB-Airsuspension must allow the amendment of this data.

Requests for the amendment of personal data can be submitted by e-mail to
VB-Airsuspension (marketing@vbairsuspension.com). VB-Airsuspension will amend the data within a maximum period of four weeks.

You acknowledge that certain services cannot be made available to you by VB-Airsuspension should you not consent to the sharing of personal data or request the restriction or deletion of personal data.

We will not use your data to make automated decisions.

VB-Airsuspension protects your personal data by working with secure sites (https). Under no circumstances may VB-Airsuspension be held liable for direct or indirect losses resulting from the improper or unlawful use of personal data by a third party.

Google Analytics

22. This website uses Google Analytics, a web analysis service offered by Google Inc. ("Google"). Google Analytics uses "cookies" (small text files that are placed on your computer) to help analyse how visitors use the website. The anonymous information regarding your use of the website generated by the cookie is transmitted to Google and stored by Google on servers in the United States. Google uses this information to track how the website is being used, to create reports on website activities for the owner of the website (VB-Airsuspension B.V.) and to offer other services relating to website activities and internet usage. Google may only provide this information to third parties if Google is required to do so by law or if these third parties process the information on behalf of Google. Google will not link your IP address to other data held by Google. You can disable cookies by selecting the appropriate settings in your browser. However, we wish to point out that in that case, you may not be able to fully utilise all the features of this website. By using this website, you consent to the processing of information by Google in the manner and for the purposes described above.

 

Concluding Note

23. The General Terms and Conditions of Delivery and Payment of VB-Airsuspension B.V. also apply to these Terms and Conditions.
24. VB-Airsuspension B.V. reserves the right to make changes to this document without prior notice.
